Rules for Creators

I. Definitions

“Amateri.com” means the Amateri.com web application, the Amateri.com mobile application and other platforms operated by the same provider.

“Provider” means the provider of Amateri.com and its authorized persons,

“Content” means photographic, visual, audiovisual, textual and other content on Amateri.com.

“User” means a user registered on Amateri.com.

“Creator” means a user who, after fulfilling the conditions specified in these RFC, is designated as a creator.

II. Introductory Provisions

1. These RFC regulate the conditions under which the creator can provide their content at Amateri.com for a fee.
2. These RFC supplement the General Terms and Conditions (“GTC”) in accordance with the provisions of Art (8) of GTC.

III. Creator

1. A creator is a user who has been designated as a creator by the provider.
2. The user can become a creator
   1. at their own request, which is subject to approval by the provider, and
   2. based on the provider's decision, taking into account the activity of the given user.
3. There is no legal claim to creator status and it can be removed at any time based on the provider's decision.
4. The Creator may establish monetized rooms (see Terms of Uploading Content and Behavior, Art VI (11) - (15)).

IV. Creator Program Membership Terms

1. The creator is obliged in particular
   1. to upload such content to which they have copyright and personality rights,
   2. to upload content of sufficient quality and length (for videos), while the provider reserves the right to check such quality and assess it individually,
   3. to upload content that is erotic in nature,
   4. to be verified by an identity that matches the uploaded content, i.e. a man uploads a man's content, a woman uploads a woman's content, etc.
   5. not to upload content downloaded from the Internet,
   6. to comply with the General Terms and Conditions and the rules and conditions subordinate to them, the law and individual instructions of the provider.
2. Serious one-time or repeated violations of the rules may result in the user being excluded from the creator program.

V. Creator's responsibility

1. The creator declares that they have the relevant business or trade license to carry out the given activity, if such is required according to the legal order of the country where the creator is registered.
2. In principle, the creator themselves is responsible for fulfilling their tax and other legal obligations resulting from the legal order of the country where the user is registered.
3. The terms of disbursement of credits in form of cash at Amateri.com obtained from the activity of the creator are governed by a separate document the Terms of Disbursement.

VI. Other Provisions

1. The creator may at any time be asked to provide additional verification by photo or an identity card issued by a state authority according to the country of residence; failure to comply with this requirement may lead to restriction or complete blocking of the profile of the given creator.
2. The provider reserves the right not to display content uploaded by the creator at all or to a limited extent, based on its own decision without prior consultation with the creator.
3. By participating in the creator's program, the creator expressly acknowledges that in the event of a violation of these RFC, the provider is entitled to a contractual fine of up to CZK 50,000 for each individual violation; the payment of the contractual penalty does not extinguish the provider's right to compensation for the damage caused.
4. The provider can enforce its rights in court; in such a case, the District Court for Prague 5 shall have local jurisdiction.

VII. Final Provisions

1. These PPTs become valid and effective on October 10, 2023.
2. In the event of a discrepancy between the individual language versions of these RFC, the Czech version prevails.
3. The decisive law is Czech law.
4. The provider reserves the right to change these RFC unilaterally, even without prior notice.
